The weakness was presented 10/24/2016 by Shi Lei with Qihoo 360 as CVE-2016-8610: SSL Death Alert: OpenSSL SSL/TLS SSL3_AL_WARNING undefined alert Remote DoS as confirmed mailinglist post (oss-sec). The advisory is shared at seclists.org. The public release was coordinated in cooperation with the project team. The mailinglist post contains:

We reported this issue to OpenSSL team in early September, and they told us they won't treat it as a security issue, but they allowed us to discuss it with whomever we wish.
This vulnerability is known as CVE-2016-8610 since 10/12/2016. The attack can be launched remotely. The exploitation doesn't need any form of authentication. Technical details and also a public exploit are known.

A public exploit has been developed by Shi Lei in Python and been published immediately after the advisory. It is possible to download the exploit at seclists.org. It is declared as proof-of-concept. We expect the 0-day to have been worth approximately $5k-$25k. The vulnerability scanner Nessus provides a plugin with the ID 97054 (Fedora 25 : 1:openssl (2017-3451dbec48)), which helps to determine the existence of the flaw in a target environment. It is assigned to the family Fedora Local Security Checks and running in the context l. The commercial vulnerability scanner Qualys is able to test this issue with plugin 175949 (Debian Security Update for openssl (DSA 3773-1)).
